SUDFIRE GENERAL TERMS AND CONDITIONS

These Terms and Conditions govern all purchases of SUDFIRE Hearth Collection products through our website at www.sudfire.com. By placing an order, you agree to be bound by these Terms, our Owner's Manual & Safety Guide, and the Supplemental Terms contained within it. Please read carefully before completing your purchase.
ARTICLE 1 — DEFINITIONS
Agreement means these Terms, your Order Confirmation, the Owner's Manual & Safety Guide, and any documents incorporated by reference.
Delivery Point means the shipping address you provide during checkout.
Products means SUDFIRE Hearth Collection products including the Hearth 34, Hearth 39, and related accessories.
Order Confirmation means the confirmation email sent to you after we accept your order, including your order number, product details, shipping address, and total amount charged.
Price means the total amount charged for your order, including product price, applicable taxes, and shipping charges.
ARTICLE 2 — ORDER PROCESS AND ACCEPTANCE
Placing Your Order You may place orders through our website checkout. You represent that all information provided is accurate and complete.
Order Acceptance We will send you an Order Confirmation email once we accept your order. The contract between you and SUDFIRE is formed when we send that confirmation. We reserve the right to decline any order. If we decline after charging your payment method, we will issue a full refund.
Order Modifications Once your order is confirmed, modifications may not be possible. Contact us immediately at info@sudfire.com if you need to modify or cancel your order.
Pricing and Payment All prices are in U.S. dollars. Prices are subject to change without notice, but changes will not affect confirmed orders. Payment is due at the time of order. We accept major credit cards and other payment methods displayed at checkout. SUDFIRE does not store your complete credit card information.
Sales Tax The Price includes all applicable state and local sales taxes based on your shipping address.
ARTICLE 3 — BATCH PRODUCTION AND DELIVERY TIMELINE
SUDFIRE Hearths are produced in limited batches. When you place an order, it is allocated to a specific production batch based on order date, payment confirmation, and product availability. Your Order Confirmation will indicate the estimated production batch and delivery window.
All delivery dates are estimates only. Actual delivery times may vary based on production scheduling, freight carrier availability, your location, weather, and other factors beyond our control. We will notify you promptly if we expect a significant delay.
ARTICLE 4 — SHIPPING AND DELIVERY
Shipping Methods Due to the size and weight of our Products, most shipments are delivered by freight carrier. Freight deliveries are typically curbside or to the nearest accessible delivery point.
Shipping Charges Shipping charges are calculated and displayed during checkout before you complete your order.
Your Responsibilities You must provide an accurate and complete shipping address. You are responsible for ensuring the delivery location is accessible to the freight carrier. Freight carriers require you to be available during the scheduled delivery window. If you miss a scheduled delivery, you may be charged redelivery or storage fees. You must inspect Products at delivery — see Article 5.
Risk of Loss Risk of loss and damage passes to you upon delivery to the carrier or your Delivery Point, whichever occurs first.
ARTICLE 5 — INSPECTION AND DELIVERY DAMAGE
You must visually inspect all Products at delivery while the carrier is present. Check packaging and Products for visible damage, dents, scratches, or missing parts.
If you discover visible damage: — Photograph damaged packaging and Products before unpacking — Note the damage with the carrier and obtain a signed acknowledgment — Keep all packaging materials and damaged components — Contact SUDFIRE immediately at info@sudfire.com with photographs and a description
You must report any visible delivery damage, missing items, or discrepancies to SUDFIRE within 48 hours of delivery. Failure to report within this window may limit our ability to file a freight claim and may void any claim for delivery-related damage. Concealed damage must also be reported within 48 hours of discovery.
ARTICLE 6 — CANCELLATIONS AND RETURNS
Cancellation Before Shipment You may cancel your order for a full refund at any time before your order ships, subject to batch production limitations. For batch reservation or pre-order orders, you may cancel for a full refund before the published batch close date. After the batch close date, cancellation requests may be declined or subject to fees.

Returns After Delivery Due to the nature of our Products (heavy, custom-produced live-fire equipment), we do not accept standard returns after delivery except in the following circumstances:
Eligible returns: — Delivery damage reported in accordance with Article 5 — Manufacturing defects covered by warranty, reported per warranty claim procedures — Nonconforming Products (wrong model or finish) reported within 48 hours of delivery
Not eligible for return: — Products that have been assembled, burned, seasoned, used, or modified — Products damaged by improper fuel, misuse, neglect, or failure to follow care instructions — Products used for commercial, rental, or event purposes without prior written approval — Opened or used accessories — Products without proof of purchase
All returns require prior written authorization from SUDFIRE. Contact info@sudfire.com to request authorization. Unauthorized returns will not be accepted.
ARTICLE 7 — LIMITED WARRANTY
SUDFIRE warrants the Hearth body and structural components against manufacturing defects for one (1) year from the date of delivery. The carbon steel cooking plate is warranted for one (1) year. Accessories, grates, and handles are warranted for ninety (90) days.
The warranty does not cover normal wear, seasoning, patina development, discoloration, rust from improper care, damage from improper fuel or misuse, delivery damage not reported within 48 hours, or commercial use without prior written approval.
To file a warranty claim, contact info@sudfire.com with your order number, a description of the issue, and photographs. Full warranty terms are set forth in the warranty section of the Owner's Manual & Safety Guide.
DISCLAIMER: EXCEPT FOR THE EXPRESS LIMITED WARRANTY DESCRIBED ABOVE, SUDFIRE MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW.
ARTICLE 8 — PRODUCT USE AND SAFETY
The Products are intended solely for outdoor residential cooking and gathering use in accordance with the Owner's Manual & Safety Guide.
Prohibited uses include: indoor use; use in enclosed or partially enclosed spaces; unattended burning; heating structures; trash burning; or use as an incinerator.
You must read and follow all instructions in the Owner's Manual before assembling, lighting, or operating the Products. You are responsible for compliance with all applicable laws, codes, and ordinances. Never leave the Products unattended while lit or hot. Keep children and pets at least six (6) feet away during use and while cooling.
Use only dry, seasoned natural hardwood or natural lump charcoal. Never use gasoline, lighter fluid, alcohol, treated wood, plastics, trash, or other prohibited fuels.
Commercial, rental, or event use is prohibited without prior written approval from SUDFIRE.
ARTICLE 9 — LIMITATION OF LIABILITY
SUDFIRE Hearth Products are live-fire cooking and gathering products. Use involves inherent risks including burns, fire, smoke, hot surfaces, sparks, embers, property damage, bodily injury, and death. By purchasing and using the Products, you acknowledge these risks and agree to use the Products in accordance with the Owner's Manual.
TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, SUDFIRE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. SUDFIRE'S TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
ARTICLE 10 — INDEMNIFICATION
You agree to indemnify and hold harmless SUDFIRE, its owners, officers, and employees from any claims, damages, or expenses arising from your use or misuse of the Products, failure to comply with the Owner's Manual, violation of any applicable law, or commercial use of the Products without prior written approval.
ARTICLE 11 — PRIVACY AND DATA USE
Our collection and use of your personal information is governed by our Privacy Policy, available at www.sudfire.com/privacy. By placing an order, you consent to our data practices as described in that policy.
ARTICLE 12 — FORCE MAJEURE
SUDFIRE shall not be liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, fire, flood, pandemic, government action, supply chain disruptions, freight carrier delays, or other causes beyond our control.
ARTICLE 13 — GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement is governed by the laws of the State of California. Any legal action arising from this Agreement shall be brought exclusively in the state or federal courts of Fresno County, California.
JURY TRIAL WAIVER: TO THE EXTENT PERMITTED BY LAW, YOU AND SUDFIRE EACH WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY ACTION ARISING FROM THIS AGREEMENT.
ARTICLE 14 — GENERAL PROVISIONS
This Agreement constitutes the entire agreement between you and SUDFIRE regarding your purchase. We may update these Terms from time to time. The version in effect at the time you place your order governs your purchase. Current Terms are always available at www.sudfire.com/terms.
ARTICLE 15 — CALIFORNIA PROPOSITION 65 WARNING
WARNING: Burning wood or charcoal can expose you to combustion byproducts including carbon monoxide, soot, smoke, and other chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. For more information, visit www.P65Warnings.ca.gov.

ARTICLE 17 — ACKNOWLEDGMENT
By placing an order, you acknowledge that you have read and agreed to these Terms, the limited warranty, the limitation of liability provisions, the safety warnings, and the California Proposition 65 warning. You acknowledge that the Owner's Manual & Safety Guide will be provided with your Product and that you agree to read and comply with all instructions before use.
